1. Who We Are

Eduspera is an e-learning platform operated by Design Excellent Group SL, NIF B02759603, registered at Calle Blanquerna 53, 07003 Palma de Mallorca, Spain ("Design Excellent Group SL", "we", "us", "our").

2. Acceptance

By creating an account or using Eduspera, you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the platform.

3. Accounts

You must be at least 16 years old (EU) or 13 years old (US) to create an account.
You are responsible for maintaining the confidentiality of your credentials.
One account per person. Organization accounts are one per legal entity.
We may suspend or terminate accounts that violate these Terms.

4. Creator Responsibilities

You own the content you publish. By uploading content, you grant Eduspera a non-exclusive, worldwide licence to host, display, and deliver it to enrolled learners.
You must not publish content that infringes third-party intellectual property, is defamatory, promotes violence, or is illegal under Spanish or EU law.
You are responsible for the accuracy of your course descriptions and any claims about outcomes.
You must make reasonable efforts to ensure your courses are accessible. The platform provides tools (accessibility score, captions, alt-text prompts) to help.

5. Learner Responsibilities

You may enroll in published courses and use the material for personal learning.
You must not redistribute, resell, or publicly share course content without the creator's written permission.
Submissions you upload remain your property. By submitting, you grant the creator a licence to view and evaluate the work.

6. Intellectual Property

The Eduspera platform, its code, design, illustrations, and brand are owned by Design Excellent Group SL.
Course content is owned by the respective creator.
Learner-submitted work is owned by the respective learner.

7. Payments (Future)

Eduspera is currently free. When paid plans are introduced, pricing, billing terms, and refund policies will be published separately and linked from these Terms. No charges will be applied without explicit consent and clear pricing information.

8. Availability & Support

We target 99.5% uptime but do not guarantee it. The platform is self-hosted; maintenance windows may occur. We provide email support at [email protected] and aim to respond within two business days.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Eduspera is provided "as is" without warranties of any kind.
Design Excellent Group SL is not liable for indirect, incidental, or consequential damages.
Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim (or €100 if you have not paid anything).

Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot be excluded under applicable law (including consumer protection laws of the EU).

10. Indemnification

You agree to indemnify Design Excellent Group SL against claims, damages, and expenses arising from your use of the platform or your violation of these Terms — except to the extent caused by our negligence.

11. Termination

You may delete your account at any time from your profile settings (or by emailing us).
We may suspend or terminate your account for a material breach of these Terms, with 14 days' notice unless the breach is severe (e.g. illegal content).
On termination, your course content and submissions will be deleted within 30 days unless legally required to retain.

12. Governing Law & Disputes

These Terms are governed by the laws of Spain. Disputes shall be submitted to the courts of Palma de Mallorca, Spain — except where EU consumer protection law grants you the right to bring proceedings in your country of residence.

EU residents may also use the European Online Dispute Resolution platform.

13. Changes

We may modify these Terms. Material changes take effect 30 days after notification by email or banner. Continued use after the effective date constitutes acceptance.
